Abstract

The globalisation of trade in goods, services and capital is having an impact on many areas of Australian law. Bankruptcy law is no exception in that, while it has largely evolved to address domestic concerns, it is having to meet the new demands of cross-border issues. This article provides an overview of the response to legal issues which may arise in bankruptcy – before, during and after an administration. It introduces the theoretical approaches which are typically canvassed in resolving such issues.
