Abstract | On 15 January 2008 the Federal Court of Australia declared the routine whale hunting being conducted by the Japanese company, Kyodo Senpaku Kaisha Ltd to be unlawful in the Australian Whale Sanctuary. This was a landmark case and one that has been consistently pursued by the applicant. The article outlines the major legal issues involved in the case as well as summarises the major steps in the litigation from the HSI application in 2004 to the January 2008 decision. |
