Abstract | This book comprises materials and commentary designed to provide an understanding of the rules and principles that regulate the process by which Australian courts determine the existence or not of facts in issue in a trial. No area of legal study can claim greater importance, for any satisfactory system of law is dependent upon an effective and satisfactory process by which the existence of the conditions for the application of rules of substantive law is determined. Evidence: Commentary and Materials is designed to be equally useful in each of the Australian jurisdictions, and statutory references to each jurisdiction are given throughout. Where the law varies from State to State these variations are elucidated. A particular effort has been made to explain and assess the changes in the law brought about by the Evidence Act 1995 (Cth and NSW), the Evidence Act 2001 (Tas), the Evidence Act 2008 (Vic), the Evidence Act 2010 (ACT), and the Evidence (National Uniform Legislation) Act 2011 (NT). |
