Abstract

For safeguarding intergenerational and intra-generational equity, Bangladesh needs to ensure sustainable utilisation and conservation of its marine area. The Constitution of Bangladesh vests the management of marine natural resources in the Republic. The government has an obligation to manage these resources as public trust properties. In several decisions, the Supreme Court of Bangladesh liberally interpreted the fundamental right to life to include the right to a healthy environment. Recently the rights of nature have received attention in the Bangladeshi constitutional jurisprudence through the fifteenth amendment of the Constitution and a judgment of the Supreme Court of Bangladesh. As the ocean is remarkably absent in the constitutional literature of Bangladesh, this chapter examines the role of the Constitution in ensuring the rights of the people and nature in the process of blue economic development.
