Abstract | This presentation encourages new thinking about ‘due diligence’ ensuring clear title to the real property rights and interests necessary for successful project delivery. Conflicts about these rights and interests – including litigation about ‘cranes, trains and little lanes’ – will be reframed as conflicts about ‘land tenure security’. Within a framework consistent with United Nations Global Sustainable Development Goals, tenure security is a person’s perception that rights and interests in land will be upheld in law and by society. The framework can encompass a diversity of stakeholder interests, agendas and understandings. While a traditional approach to ‘due diligence’ can fragment collaborative solutions, an orientation to ‘land tenure security’ provides precise, shared language, common understandings and a clear agenda. |
