Abstract | The aim of this article is to critically assess the question of whether a statement on the international level is still necessary and beneficial to clarify that LGBT people are protected under international human rights law in light of the growing authoritative commentary and jurisprudence on the international level. This article also contemplates the risks and benefits associated with the adoption of such a statement, and whether an alternative approach, such as a dialogic approach, may be better suited on the international level to improve the treatment of LGBT people in Member States. |
