Abstract | Proposals to change the Australian Constitution to recognise Aboriginal and Torres Strait Islander Peoples have been considered and discussed for many years now. This chapter provides an overview of the current debate over what form the recognition of Aboriginal and Torres Strait Islander Peoples should take. More specifically, this chapter discusses recommendations put forward in 2012 by the Expert Panel on Constitutional Recognition of Indigenous Australians and in 2015 by the Joint Select Committee on Constitutional Recognition of Aboriginal and Torres Strait Islander Peoples. It also notes the substance and effect of the Aboriginal and Torres Strait Islander Peoples Recognition Act 2013 (Cth) and briefly summarises recent proposals by the Cape York Institute. In light of these key documents, the chapter considers what ‘recognition’ might mean and how these various recommendations for constitutional reform have been received. |
