Abstract | This thesis examines the potential for the collaborative process as a tool for dispute management in Australian civil matters. It applies exploratory research methods to first understand collaborative practice in its present use, which is predominantly as a tool for family law matters, and then explores how the process can assist parties in other types of dispute. The areas most suited to collaborative practice are identified, and the barriers to its expansion into these fields are considered. The thesis concludes with recommendations to support the expansion of the collaborative process and an illustrative example of how the process might be applied in a commercial setting. |
