Abstract | The premises liability (Zustandshaftung) is an important concept under the German administrative law. It consists of the legal basis of contaminated land liability system of the Federal Soil Protection Law and the Regulations of Federal Soil Protection and contamination. This article discusses the elements of the premises liability. Based on analysis to the selected contaminated land cases in Germany, this article also looks at the possibility of introducing the premises liability in China’s contaminated land legislation. |
