Abstract

This case is the first environmental public interest litigation initiated and concluded by a social organisation following the amendment of the Civil Procedure Law. During the trial, the court explored the following three aspects: the planning and approval process, and the project played a significant role in the overall development, involving public interests. Direct restoration to the original state was not feasible. Given these circumstances, the trial court, after consulting professional institutions, adopted the offsite replanting approach for ecological restoration. This approach explored ways for environmental polluters and ecological disruptors to assume civil liability, avoided the waste of social resources, and restored ecological capacity across the broader region, providing a model for reference.
