Abstract | This article considers the new consumer law provisions allowing a court to review terms of standard form contracts that might be considered to be unfair. It considers how the new provisions compare with existing statutory regimes for the review of contracts, as well as the common law, and considers the provisions in light of regimes existing in some Australian states and overseas. |
