Abstract | This paper considers the constitutional implications of a suggested ban on dress often associated with religion, such as a burqa or hijab. It considers specifically s116 of the Commonwealth Constitution, as well as the extent to which anti-discrimination legislation might be useful in challenging such a ban. |
