Abstract | This article considers the existing quarantine legislation and the proposed new biosecurity legislation in terms of their constitutionality, and more broadly, their public policy merit or otherwise. It concludes the proposed new legislation is a vast improvement on the existing quarantine legislation, not surprising given it was first passed more than a century ago. |
