| Abstract | This paper considers a recent High Court decision where, by a slim majority, the Court validated a measure whereby a person affected by a decision may not have access to information taken into account regarding the decision made. The decision indicates that, in time, a tougher approach might be taken to the constitutionality of such measures. |
