| Abstract | This paper argues reflects on increased incidences of 'gag' clauses in funding contracts with community service providers. Such clauses require, as a condition of government funding, that the funded provider not engage in advocacy. The paper mounts an argument that such a condition is a breach of the implied freedom of political communication, by silencing a community body that would otherwise contribute to public debate on contentious issues, a body providing a platform for voices that may otherwise be marginalised from political debate. |
