Abstract | This papers considers the question of vicarious liability in the context of liability of educational providers for abuse committed against students. Vicarious liability struggles to deal with cases of intentional misconduct. This paper argues it is preferable to view the liability of educational institutions in such cases in terms of agency principles, or in terms of direct liability for negligence. |
